Merele W. Spellmeyer, a longshoreman employed by the Port of Longview to assist in moving Weyerhaeuser wood pulp out of port storage facilities for further shipment, relies on theories of negligence and strict liability in seeking to fix liability upon Weyerhaeuser Corporation for personal injuries received when he was struck by bales falling from a disintegrating, 8-bale unit of pulp. This is an appeal from a summary judgment dismissing the action. We affirm as to the theory of strict liability, but reverse and remand for trial on the theory of negligence.
